Lindsay Lohan Is 'Angry' About Jail Sentence

The actress returned to Lynwood Jail on Friday after a topsy-turvy day in court, and she is frustrated with the status of her jewelry theft case.

"She is fine," says producer Nathan Folks, who is a close friend of Lohan, 24. "Obviously, she is upset about [being sentenced to four months in jail]."

On Friday, a judge found Lohan, who is accused of stealing a $2,500 necklace, in violation of probation and sentenced her to the jail time and a hefty 480 hours of community service, which Folks admits was a "setback."

But she was allowed to post bail and released within hours of getting booked. Lohan remains free pending an appeal of the sentence, which legal experts say she has slim chance of winning.

"She is angry because she has been working so hard on turning her life around," says Folks, who insists Lohan is clean and sober. "She didn't do what they said she did. She didn't steal that necklace."

Still, Lohan is resigned to accept whatever decision comes down from the court when her trial begins June 3.

"She is ready to do her time. She wants to go to A.A. and N.A. and to serve her [more than] 400 hours [of community service]," Folks says. "She has already been doing lots of charity work."

Lindsay Lohan Sentenced to 120 Days Jail Time

It turned out not to be a Good Friday for Lindsay Lohan!

Judge Stephanie Sautner ruled that the actress was in violation of her probation and would receive 120 days in jail, Us Weekly confirmed.

Lohan, 24, was was only charged with a misdemeanor for her alleged necklace theft in January; she turned down previous plea deal bargain offers prior to Friday's trial and faced the possibility of felony charges. She will be tried in 45 days.

However, Judge Sautner ruled the incident was a violation of the probation terms set forth after Lohan's 2007 DUI arrest. In addition to her 120 day jail sentence, she will be required to perform 360 hours of community service.

Lohan's lawyer, Shawn Holley, immediately filed a notice of appeal. The actress' bail is set at $75,000.

Lindsay Lohan -- The Perils of a Plea Bargain

TMZ broke the story ... Judge Keith Schwartz has indicated he would give Lindsay 3 months in jail if she cops a plea. That sentence translates to 19 days because of jail overcrowding.

But sources connected with the case tell TMZ ... Judge Schwartz reserved the right to change the sentence depending on the evidence that surfaces during Friday's hearing. And here's the bad news for Lindsay.

-- We've learned prosecutor Danette Meyers -- who is asking for 6 months in jail -- will argue Lindsay's performance on probation has been "unsatisfactory." She has missed AA meetings, gone to class with tea laced with alcohol and missed court appearances.

-- As TMZ reported on February 9, Meyers will allege Lindsay has a history of stealing -- a $12,000 mink coat in 2008, a $400,000 necklace in 2009, and a $35,000 Rolex in 2010.

-- The judge will read and consider Lindsay's probation report. As TMZ first reported, there is information in that report which is extremely damaging to Lindsay, and could impact her sentence.

If the judge feels Lindsay's conduct is worse than he thought when he met with Shawn Holley a few weeks ago, he could up the sentence ... possibly to 6 months.

And here's the biggest problem for Lindsay. If she accepts the plea, Schwartz will place Lindsay on 3 years probation. And what are the chances Lindsay Lohan can stay out of trouble for 3 years?

Lindsay Lohan's Klepto Past To Form Case

Lindsay Lohan's lawyer must notify Judge Keith Schwartz by Wednesday, March 23 if she plans on taking a plea deal, and Radar Online is exclusively reporting that if the actress doesn't take the plea deal, Deputy District Attorney Danette Meyers will include as part of her case, past incidents in which Lindsay has been accused of theft.

"There is very damaging information about Lindsay's past evidence of thefts, including a stolen Rolex, which a friend of hers reported as stolen last April 2010, which will be made public if Lindsay doesn't take the plea deal. Lindsay was investigated by the Los Angeles County Sheriff's Department last spring after a friend reported that after leaving the Rolex at Lohan's apartment, it wasn't returned immediately. Actually, it was quite a bit of time later that the watch was returned to the person. The watch was valued at a whopping, 35k, and like the current theft case, Lindsay was photographed wearing the watch. Lindsay wasn't charged in that case because the victim became uncooperative as soon as the watch was returned. The D.A. will be sending investigators out from the office to talk to the victim. Meyers wants to know if there was a financial pay off" a source close to the situation tells us.

Lohan, 24, was also accused of stealing a mink coat from Maria Markova in New York City in January 2008. Markova said at the time that Lohan took the coat at a nightclub, 1 Oak. The coat was valued at $12k. Markova claimed she was sitting next to Lohan at the club when the coat was allegedly stolen. Markova said the next time she saw the coat, Lohan was wearing it in a magazine picture. Lindsay was not criminally charged in that incident either. "Meyers will be reviewing that information as well. It will absolutely be brought up either at the preliminary hearing or the trial. This will establish a pattern of behavior on, that Meyers will prove beyond a reasonable doubt that Lindsay is guilty in this case."

"It doesn't matter that Lindsay wasn't criminally charged in those previous incidents. Meyers can, and will subpoena police that investigated those, and as well as the accusers if she needs to. Lindsay has major entitlement issues, which have led her down this very dark road. If Lindsay is smart, she will take the plea deal. Lindsay won't know what will hit her if the case proceeds to a preliminary hearing, and trial. Meyers is tough as nails, make no mistake about it. Lindsay truly has no idea how bad this could get, and how fast. This could truly ruin her career. Look at the (Winona) Ryder case, her career suffered after the guilty conviction, and she didn't have the criminal record that Lindsay has," the source says.

Lindsay Lohan: Warming Up To Idea Of Jail Time

Lindsay Lohan's confidence is starting to wane -- sources close to LiLo tell us she is finally getting it through her head she can't avoid jail and is now "seriously considering" taking a plea deal.

As TMZ first reported, Judge Keith Schwartz offered LiLo and her attorney Shawn Holley a deal that includes three months in jail ... which get whittled down to 19 days because of jail overcrowding.

Lindsay has been adamant for weeks ... she would never take a plea deal because she feels she did nothing wrong. Sources close to Lindsay tell us she still maintains her innocence ... but reality is starting to sink in and Lindsay is beginning to understand the risks of going forward with a trial.

If she loses at trial, she could get more than a year in jail for the probation violation ... plus prison time for the felony grand theft.

If Lindsay accepts the deal, Holley must tell the judge on Wednesday. Lindsay will be back in court Friday to either take a plea or declare war.

Lindsay -- I Won't Take Plea Deal with Jail Time

Lindsay Lohan doesn't care what her lawyer is negotiating ... she's not going to cop a plea to anything if it involves jail time ... sources connected to LiLo tell TMZ.

TMZ broke the story ...Shawn Holley is trying to broker a plea deal that will almost certainly involve jail time. Holley and prosecutor Danette Meyers are going to see Judge Keith Schwartz next week, and Holley wants to take the judge's temperature on how much jail time he'll give her if she pleads guilty. The judge made it clear at the last hearing -- Lindsay WILL do time -- probably 3-6 months.

But sources close to Lindsay tell TMZ ... she doesn't care what kind of deal Holley gets -- if there is ANY jail time involved, she wants no part of it. We're told Lindsay wants to go to trial and believes the surveillance tape will clear her name.

Lindsay Lohan Will Get Jail in a Plea Deal

The next time Lindsay Lohan comes to court she may need to bring a toothbrush.

A tough-talking Superior Court Judge Keith Schwartz told the troubled actress Wednesday that the only way he'll accept a plea bargain in her felony theft case is if she goes to jail.

"I treat everybody the same," he told her at a hearing in Los Angeles. "I don’t care that you're Lindsay Lohan vs. John Doe or Jane Doe. That doesn't affect me."

The judge set a March 10 deadline: Return to his court that day with her decision or go before another judge for a preliminary hearing and later trial on a charge she stole a $2,500 necklace.

"If you plead in front of me, if this case is resolved in front of me, you are going to go to jail. Period," he said.

The actress faces a grand theft charge for allegedly walking away with the necklace from a jewelry store last month. Lohan has indicated it was all a mistake, that she thought she was allowed to borrow the necklace. Sources say her attorney may also claim it was wroth much less than $2,500, which would drop the case from a felony to a misdemeanor.

If Lohan decides against a plea deal next month and goes to the preliminary hearing, her risk of jail time remains. At that same hearing, the new judge will consider whether she should face punishment for violating her probation in an earlier DUI case.

Lindsay Could Escape Jail – Even If Convicted

"This is far from a slam-dunk case," says L.A. criminal defense attorney Steve Sitkoff of the allegation that the actress, 24, stole a $2,500 necklace.

"All her attorney has to do is convince one juror it was an innocent misunderstanding and she could walk, unless they decide to retry her again."

Adds L.A. criminal defense attorney Harland Braun: "Even if she's convicted, I doubt she'll get state prison time because she's not a physical threat to the public. Prison is generally regarded as a place for hardened criminals, not someone who clearly has mental issues. She has a defensible case."

Experts also agree that her past theft allegations could be used against her in court depending on whether the judge finds the accusations relevant.

Here are among the possible resolutions to the actress's case:

• Lohan could reach a plea deal without going to trial, and be sentenced to anywhere from six months to a year in county jail for the alleged theft as well as for violating her probation. "In this case, the court could figure out a way to make sure she does substantial time and forbid her from early release due to overcrowding," Sitkoff says.

• She could also strike a deal in which she only gets felony probation with no jail time and if she stays out of trouble for three years, the judge could reduce the charge to a misdemeanor. Lohan's attorney Shawn Chapman Holley stated on Thursday she was seeking this as a possible outcome.

• The actress wins at trial by convincing jurors she didn't intend to steal. However, Lohan could still face a probation violation and return to jail without a conviction in the theft case.

• Lohan could go to trial and lose, and could be subject to harsher punishment if the judge decides she was being deceitful to the court. "But if she loses at trial, I can't see her getting more than eight months in state prison," Braun says.

Teen Mom's Amber Portwood Is In Jail

TMZ has obtained the mug shot of "Teen Mom" Amber Portwood -- taken moments after she was arrested in Indiana for allegedly beating the crap out of her baby daddy ... in front of their daughter.

According to Amber's booking sheet -- the 20-year-old measured in at 5'3", 138 lbs.

Amber was charged with two felony counts of domestic battery, one felony count of neglect of a dependent, and one misdemeanor count of domestic battery.

As we previously reported, Amber allegedly attacked Gary Shirley three separate times between August 2009 and July 2010. Some of the violence was captured on video.

We're told Amber faces three years behind bars and up to $10,000 in fines if convicted on all charges.

Is Lindsay Lohan Headed Back to Jail?

L.A. Superior Court Judge Elden Fox may be faced with having to make good on his threat of more incarceration for Lohan if she violated probation in a DUI case.

"If the latest allegations are true, it just spells disaster for Lindsay," says L.A. criminal defense attorney Richard Hirsch, who's not involved with the case. "After all the chances she's had, the judge may have no other option left."

Two months ago, Fox spared Lohan from jail after she failed a drug test, convinced that the actress – an admitted addict – needed more treatment and ordered her to remain at the Betty Ford Center until at least Jan. 3.

"I agree that relapse is a part of recovery, but I'm not going to be manipulated," Fox said, threatening her with six months behind bars if she slipped up again.

The actress, 24, has so far served three stints at a Lynwood, Calif., jail.

"Judge Fox isn't one to make idle threats," says another L.A. criminal defense attorney, Steve Sitkoff. "Especially if he decides that Lindsay was the instigator in the scuffle with the Betty Ford employee, that'll make him more likely to punish her with jail instead of treatment."

As of Wednesday, both the L.A. District Attorney and Fox had not been officially notified of Lohan's alleged infractions.

The Hills' Jason Wahler Sent to Jail

Lauren Conrad's ex boyfriend Jason Wahler is currently being held in a jail in Washington state, Usmagazine.com has confirmed. "Yes, he's in our facility," an official at the Yakima County Jail -- located about 150 miles outside of Seattle -- tells Us.

RadarOnline.com first reported that Wahler, 22, was booked on charges of assault and minor drinking in Seattle on Sept. 25. He was transferred to Yakima County Jail four days later.

"He will serve 120 days in jail but could get out after 80 days for good behavior," an official told RadarOnline.com. This isn't the first time Wahler has gotten in trouble with the law.

In 2008, a judge ordered him to rehab after he punched a tow truck driver in the face and used racial slurs him. He spent 18 days in jail in 2007 after getting arrested on charges of assault for fighting in the lobby of a Seattle Marriott hotel.

That same year, he was picked up by police twice: once in Greenville, N.C. in 2007 for underage drinking and resisting arrest, and another time in NYC for resisting arrest and bribery.

Conrad famously refused an internship in Paris because she wanted to stay close to Wahler while they were dating. The two also reportedly filmed a sex tape together, rumors of which were leaked by Spencer Pratt -- ending the friendship between Conrad and Heidi Montag. Conrad denies the sex tape exists.
